新闻出版署、教育部、国家版权局、全国“扫黄”“打非”工作小组关于坚决制止各级各类学校使用盗版教材的通知

最近一段时间，各地教育、新闻出版、版权管理部门和“扫黄”“打非”办不断接到投诉或举报，反映在学校存在使用盗版教材的问题。有的学校通过非法渠道购买盗版教材，有的学校甚至擅自印制盗版教材。这种情况一直没有得到有效遏止。它不但严重损害了著作权人和出版单位的
合法权益，扰乱了教材发行秩序，而且由于许多盗版教材粗制滥造，错误百出，也直接影响到教学质量，误人子弟。广大师生对此非常愤慨。同时，盗版分子以高额回扣为诱铒，严重腐蚀教工队伍，甚至使一些教工人员走上贪污犯罪的道路。为坚决制止和杜绝这种情况的发生和蔓延，特通
知如下：
一、各地教育行政部门要立即对当地所有学校教材使用情况进行清查，对已出现的订购盗版教材的情况，要立即向当地新闻出版、版权部门和“扫黄”“打非”办报告，积极协助对盗版教材的制作者和发行者进行查处；对学校内部人员正在非法印制盗版教材的，要立即停止生产；对已
投入使用的盗版教材，要采取有效措施用正版教材替代。在清查工作中，对学校有关责任人员要以批评教育为主。对能认真自查，如实交代问题，退出非法所得，保证不再重犯的，一般不予追究。对情节严重、态度恶劣的，要视具体情况给予党纪、政纪处分，并提请当地新闻出版、版权部
门和“扫黄”“打非”办进行处理。涉嫌构成犯罪的，要移交当地司法部门依法追究刑事责任。
各地教育行政部门要建立健全教材使用的管理制度，杜绝盗版教材进入学校。
二、各地新闻出版局要根据《出版管理条例》的规定，认真对教材的发行渠道进行清理、整顿。对为保证多种版本，少批量的高校教材能课前到书而出现的新的教材发行渠道和发行方式，应进行引导和规范。对违反规定的出版或发行单位及个人要进行严肃处理。涉嫌构成犯罪的，要移
交当地司法机关处理。
三、各地版权局、“扫黄”“打非”办要密切配合当地教育行政部门对各学校使用盗版教材的清查工作和当地新闻出版局对教材出版、发行秩序的整顿工作。各地版权局对因从事盗版活动构成侵权的单位或个人，要视情况依《中华人民共和国著作权法》及其实施条例进行行政处罚。涉
嫌构成侵犯著作权罪的，要移交当地司法机关处理。
四、各地教育行政部门、新闻出版局、版权局和“扫黄”“打非”办要积极配合，密切协作，认真做好对盗版教材问题的查处工作，并从这次查处工作中总结经验，吸取教训，严格按照有关法律、法规的规定，加强各学校对教材使用和教材出版发行工作的管理，加强著作权法的执法力
度，严厉打击各种形式的非法出版、经营和盗版教材活动，坚决制止和杜绝使用盗版教材情况的再度发生。
请各省、自治区、直辖市教育厅（教委）、新闻出版局、版权局和“扫黄”“打非”办将各自的处理情况于2000年12月1日前分别向教育部、新闻出版署、国家版权局和全国“扫黄”“打非”工作小组提交书面报告。
