第一条 为了保护环境,保障人民健康,促进企业、事业单位加强经营管理,节约和综合利用资源,治理污染,根据《中华人民共和国环境保护法(试行)》和国务院《征收排污费暂行办法》,结合本省具体情况,制定本规定。
第二条 在我省范围内的一切企业、事业和其他单位排放的污染物,凡超过国家颁发的《工业“三废”排放试行标准》、《工业企业设计卫生标准》、《放射性防护规定》,或者超过省规定排放标准的,均要征收排污费。
排污单位缴纳排污费,并不免除其应承担的治理污染、赔偿损害的责任和法律规定的其他责任。
第三条 排污费的征收,根据各种污染物的危害大小、超过排放标准的倍数或数量分类、分级确定。
(一)废水
按污水类别和污水浓度所超过排放标准的倍数确定收费标准。
污染物分类:第一类:PH值、化学耗氧量、生化需氧量、悬浮物;第二类:硫化物、挥发性酚、氟的无机化合物、石油类、有机磷、铜及其化合物、锌及其化合物、氰化物、硝基苯类、苯胺类;第三类:汞、镉、砷、铅及其无机化合物、六价铬化合物;第四类:病原体。
(二)废气
(1)烟尘:各种锅炉和工业炉窑排放的烟尘,按林格曼浓度或超标倍数收费。
(2)生产性粉尘:第一类:玻璃棉、矿渣棉、石棉、铝化物;第二类:电站煤粉、水泥粉尘;第三类:炼钢炉粉尘、其他粉尘,以超标排放量收费。
(3)十二种废气:第一类:二氧化硫、二硫化碳、硫化氢、氟化物、氮氧化物、氯、氯化氢、一氧化碳,以超标排放量收费;第二类:硫酸(雾)、铅、汞、铍化物,以超标浓度收费。
(三)废渣
第一类:含汞、镉、砷、六价铬、铅、氰化物、黄磷及其他可溶性剧毒物废渣,未经无害化处理任意堆放或向水体倾倒的,按废渣重量收费;第二类:电厂粉煤灰;第三类:其他工业废渣。上述二、三类废渣,向水体倾倒或无专设堆放场所的,按重量收费。
(四)噪声
凡超过《城市区域环境噪声标准》的,按超标分贝数确定收费标准。
在征收排污费时,排污单位所排放的废水、废气、废渣中,同一排污口含有两种以上有害物质时,应当按收费最高的一种计算。
第四条 排污费的征收标准,按照国务院《征收排污费暂行办法》附表的规定,由省环境保护局制订具体实施办法。
第五条 凡有下列情形之一者,要加倍收费:
(1)《中华人民共和国环境保护法(试行)》公布以后,新建、扩建、改建的工程项目和挖潜、革新、改造的工程项目排放污染物超过标准者;
(2)为逃避收费,用稀释方法降低排放浓度或采取其他欺骗行为者;
(3)国家或地方有限期治理要求和可靠措施,到期未达到预定要求者;
(4)已有治理设施闲置不用或擅自拆除者。
第六条 排污单位经过治理已经达到排放标准的,或减少排污量和降低污染物浓度有显著成效的,可向环境保护部门申请,经监测核实,可停止或减少收费。
减少或停止收费以后,排放的污染物又增高或超标的,仍应增加或恢复收费。
排污单位因各种原因停止排污,连续半个月以上的,经环境保护部门批准后,停止排污期间免收排污费。
第七条 对缴纳排污费后仍未达到排放标准的排污单位,从开征第三年起,每年提高征收标准百分之五。
第八条 排污单位应当如实地向当地环保部门申报、登记排放污染物的成份、浓度和数量,经环保监测站或其指定的监测单位核实后,作为征收排污费的依据。对监测数据有争议时,以上一级环保监测的监测数据为准。
第九条 根据监测部门提供的监测数据,环保部门确定排污单位缴费金额,向排污单位发出“征收排污费通知书”,同时抄送有关部门。主管部门应督促缴费单位按时缴纳排污费。
第十条 排污单位接到环境保护部门的“征收排污费通知书”,在二十天内,向指定银行缴纳排污费。逾期不缴的,每天增收滞纳金千分之一。
中央部属和省属排污单位的排污费,缴入省级财政;地属和市属排污单位的排污费,分别缴入地、市财政;县属及县以下的排污单位的排污费,缴入县财政。
企业单位缴纳的排污费,从生产成本中列支。提高征收标准的部分,全民所有制企业在利润留成或企业基金中列支;实行“利改税,独立核算,自负盈亏”的全民所有制企业和集体所有制企业,在缴纳所得税后的利润中列支。事业单位缴纳的排污费,先从单位包干结余和预算外资金中
开支,如有不足,可以从单位事业费中列支。
第十一条 征收的排污费,纳入预算内,作为环境保护补助资金,按专项资金管理,不参与体制分成。
环境保护补助资金,要坚持专款专用,先收后用,量入为出,不得移作他用。年终有结余的,可结转下年度使用。财政部门、建设银行和各单位财务部门要加强监督,不符合规定的,一律不得开支。违反规定的,要追究当事人和领导者的责任。
第十二条 环境保护补助资金,应当主要用于补助重点排污单位治理污染源以及环境污染的综合性治理措施。
排污单位在采取治理污染措施时,应当首先利用本单位自有财力进行,如确有不足,可报经主管部门审查汇总后,向环境保护部门和财政部门申请从环境保护补助资金中给予一定数额的补助。这种补助一般不得高于其所缴纳排污费的百分之八十。使用计划由环保部门、主管部门、财政
部门共同审定。属于第五条所列情况的单位,不予补助。
环境保护补助资金的百分之十,可用于环保部门监测仪器设备等方面的专项支出。但不得用于环境保护部门自身的行政经费以及盖办公楼、宿舍等非业务性开支。由财政部门实行监督。
其余部分用于综合性治理,由环境保护部门会同财政部门统筹安排使用。
第十三条 环境保护补助资金,用于污染源和综合性治理的资金,通过建设银行监督拨款。
第十四条 违反《浙江省防治环境污染暂行条例》,有下列情形者,要追究责任,限期治理,并予以罚款:
(1)事故性排放污染物者;
(2)污染严重,逾期不治,直接危害人民群众身体健康,使工农业生产和自然资源遭受破坏者;
(3)向饮用水源防护地带、风景游览区、水产养殖区等排放有毒有害污染物者;
(4)工矿企业将污染严重的产品下放到街道、社队企业生产,没有落实治理措施,造成环境污染者;
(5)有毒有害废水采用渗坑、渗井排放,有毒有害废渣埋入地下、排入河道,造成环境污染者;
(6)一般工业废渣,无防止扬散、流失等措施,排入江河湖泊、农田造成环境破坏者;
(7)运输过程中撒泼、泄漏、散失有毒物品者;
(8)在居民区焚烧沥青、塑料、油毛毡等散发有毒有害物质,在江河中洗涤有毒有害物质,造成环境污染者。
第十五条 罚款按企业、事业单位隶属关系进行审批:一万元以内由县(市)环境保护部门决定,三万元以内由地(市)环境保护部门决定,五万元以内由省环境保护部门决定。超过以上数额的,按企业隶属关系,分别报同级人民政府批准。
第十六条 企业单位罚款应由企业利润留成基金或企业基金中支付,不得列入生产成本。事业单位从单位的预算外资金或包干结余中支出。罚款全部缴入当地环境保护部门,作为环境保护专用资金。
对被罚款单位的主要领导人和直接责任者,根据情节轻重要停发一至六个月的奖金。
第十七条 本规定自1982年7月1日起执行。

第一条 为了加强对外经济开放地区的环境管理,防治环境污染和生态破坏,保障人体健康,保护和创造良好的投资环境,促进经济和社会发展,特制定本规定。
第二条 本规定所称对外经济开放地区,是指国家批准的经济特区、沿海开放城市和沿海经济开放区。在对外经济开放地区从事生产、经营活动的一切单位和个人,必须遵守本规定。
第三条 对外经济开放地区的各级人民政府,必须坚持“预防为主、防治结合”的方针,加强环境综合整治工作。应当把环境保护纳入本地区的经济和社会发展规划,明确环境保护的目标、任务和措施,并组织实施。
第四条 对外经济开放地区进行新区建设必须作出环境影响评价,全面规划,合理布局。各有关部门必须严格按照规划和布局的要求进行建设。对外经济开放地区现有的不合理布局,应当结合城市改造、工业调整逐步加以解决。在生活居住区、水源保护区、疗养区、自然保护区,风景游览区、名胜古迹和其他需要特殊保护的地区,不得建设污染环境的项目;已建成的,要限期治理、调整或搬迁。
第五条 管辖对外经济开放地区的省、自治区、直辖市人民政府,对国家环境质量标准中未规定的项目,可以制定地方补充标准;对执行国家污染物排放标准不能保证达到本地区环境质量要求的,可以制定严于国家污染物排放标准的地方污染物排放标准,报国家环境保护部门备案。按照前款规定制定的地方污染物排放标准,所在地的企业、事业单位必须执行。
第六条 对外经济开放地区从国外引进技术和设备,必须符合无污染或少污染的要求,对产生污染,国内又不能配套解决的,应当同时引进相应的环境保护设施。一切新建、改建和扩建项目,必须做到防治环境污染的配套设施与主体工程同时投入使用。
第七条 对外经济开放地区的一切单位和个人,在签订经济合同时,应当明确当事人各方在环境保护方面的义务和责任,落实防治环境污染的措施。合同中不得有违反国国家和地方环境保护法律、法规的内容。
第八条 在对外经济开放地区进行开发建设的单位,必须按照国家规定报送环境影响报告书(表)和建设项目初步设计环境保护篇章;竣工后,必须报送环境保护设施竣工验收报告。环境保护部门应当在接到环境影响报告书(表)的四十五日内,初步设计环境保护篇章、环境保护设施竣工验收报告的三十日内予以批复;逾期不批复的,上报方案自行生效。
第九条 对外经济开放地区的企业事业单位排放污染物,必须到所在地人民政府环境保护部门提出排污申请,如实填报拥有的污染物排放设施、处理设施和在正常作业条件下排放污染物的种类、方式、数量和浓度,经审核批准并取得排污登记证件后,方能生产或营业。排污情况发生变化的,应当及时向所在地人民政府环境保护部门申报。超过国家或地方污染物排放标准的,按照国家规定缴纳超标准排污费;向水体排放污染物的,按照国家规定缴纳排污费。
第十条 对外经济开放地区各级人民政府的环境保护部门,负责组织、协调、监督、检查本地区的环境保护工作。被监督检查单位必须如实提供有关情况和资料。环境保护部门对被监督检查单位提供的情况和资料有保密的义务和责任。
第十一条 凡违反本规定,造成污染损害的单位,对外经济开放地区各级人民政府的环境保护部门或国家规定的其他主管部门,可以责令其限期治理,支付消除污染费用,赔偿损失;并可以给予警告或罚款。当事人不服的,可以在收到决定书之日起十五日内,向人民法院起诉;期满不起诉又不履行的,由环境保护部门或其他主管部门提请人民法院强制执行。
第十二条 对外经济开放地区所在的省、自治区、直辖市人民政府可以根据本规定制定实施办法。
第十三条 本规定自发布之日起施行。

INTERIM PROVISIONS FOR THE ADMINISTRATION OF THE ENVIRONMENT IN
THE ECONOMIC ZONES OPEN TO THE OUTSIDE WORLD
(Approved by the State Council on March 4, 1986 and promulgated by
the State Administration for Environmental Protection on March 15, 1986)
Article 1
These Provisions are formulated for the purpose of strengthening the
administration of the environment in the economic zones open to the
outside world, preventing and remedying environmental pollution and the
disruption of ecological balance, safeguarding human health and protecting
and creating good investment environment so as to promote economic and
social development.
Article 2
The term "economic zones open to the outside world" as used in these
Provisions refers to the special economic zones, the open coastal cities
and the coastal economic development areas approved by the State.
All units and individuals that are engaged in production and business
activities in the economic zones open to the outside world shall abide by
these Provisions.
Article 3
People's governments at various levels in the economic zones open to the
outside world shall adhere to the principles of "having prevention as the
main concern and combining prevention with remedying" and strengthen the
work for the comprehensive improvement of the environment. They shall
incorporate environmental protection into the economic and social
development plans of their own localities and specify the targets, tasks
and measures with respect to environmental protection and organize the
implementation thereof.
Article 4
It shall be imperative to evaluate the impact on the environment, carry
out overall planning and ensure rational distribution, if construction of
new areas is to be undertaken in the economic zones open to the outside
world. All departments concerned shall carry out the construction in
strict accordance with the requirements in respect of planning and
distribution.
The existing irrational distribution of the economic zones open to the
outside world shall be rectified gradually in conjunction with urban
reform and industrial readjustment. In residential areas, water-resource
reserves, health resorts, nature reserves, tourist resorts, scenic spots
and places of historic interest, and other areas which need special
protection, no projects that may cause environmental pollution may be
constructed and a deadline shall be set for any such projects that have
been completed to be improved, readjusted, or removed.
Article 5
With respect to projects that are not covered by the State provisions
concerning the standards of environmental quality, the people's
governments of the provinces, autonomous regions and municipalities
directly under the Central Government having jurisdiction over the
economic zones open to the outside world may formulate their own local
supplementary standards. If the implementation of the State standards
concerning the discharge of pollutants fails to satisfy the requirements
for environmental quality of their own localities, they may formulate
their own local standards concerning the discharge of pollutants which are
stricter than the State standards concerning the discharge of pollutants
and submit them to the State departments for environmental protection for
the record.
The local standards concerning the discharge of pollutants formulated in
accordance with the provisions of the preceding paragraph shall be
implemented by the enterprises and institutions in the localities.
Article 6
Technology and equipment introduced from abroad into the economic zones
open to the outside world shall conform to the requirement that they shall
cause no pollution or little pollution. If the technology or equipment to
be introduced from abroad will cause pollution and no means is yet
available at home to tackle it, the corresponding environmental protection
facilities shall be introduced simultaneously. With respect to all newly-
constructed projects, alteration projects or expansion projects, it shall
be imperative to ensure that both the supporting facilities for preventing
and remedying environmental pollution and the principal part of the
project are put into operation simultaneously.
Article 7
When entering into an economic contract, all units and individuals in the
economic zones open to the outside world shall specify the obligations and
responsibilities of each of the parties thereto in respect of
environmental protection and ensure that measures for preventing and
remedying environmental pollution are duly stipulated. The contract may
not contain anything that runs counter to the laws and regulations of the
State or of the locality for environmental protection.
Article 8
Units that intend to engage in developmental construction in the economic
zones open to the outside world shall, in accordance with the pertinent
provisions of the State, submit an environmental impact report/form(s) and
a text on environmental protection in the preliminary design of a
construction project and shall, upon completion of the project, submit a
report on inspecting and accepting the completed environmental protection
facilities.
The department for environmental protection shall, within 45 days of
receipt of the environmental impact report/form(s) or within 30 days of
receipt of the text on environmental protection in the preliminary design
of a construction project and the report on inspecting and accepting the
completed environmental protection facilities, give an official written
reply to the unit that has submitted the above-mentioned documents. If no
such reply is given within the prescribed period of time, the documents
submitted shall automatically become effective.
Article 9
Enterprises and institutions in the economic zones open to the outside
world that have to discharge pollutants shall apply to the departments for
environmental protection under the local people's governments for
permission to discharge pollutants and fill in forms to report truthfully
on the pollutant discharging and treating facilities that they possess and
the kind(s) of pollutants to be discharged, the mode(s) of discharging,
and the quantity and density of the pollutants under normal operational
conditions. Their production or business operations shall begin only
after the application has been verified and approved and the document for
the registration of pollutant discharge has been obtained. If changes have
taken place in the discharge of pollutants, these shall be reported in
good time to the departments for environmental protection under the local
people's governments.
Those that discharge pollutants in excess of the State or local standards
shall pay an excess pollutant discharge fee in accordance with the
pertinent provisions of the State; those that discharge pollutants into
water shall pay a pollutant discharge fee in accordance with the pertinent
provisions of the State.
Article 10
The departments for environmental protection under the people's
governments at various levels in the economic zones open to the outside
world shall be responsible for organizing, co-ordinating, supervising and
inspecting the work of environmental protection in their own localities.
The units that are subjected to supervision and inspection shall provide
the actual relevant information and data.
The departments for environmental protection shall undertake the
obligation and responsibility to maintain the confidentiality of the
information and data provided by the units that are subjected to
supervision and inspection.
Article 11
The departments for environmental protection under the people's
governments at various levels in the economic zones open to the outside
world or other competent departments may order those units that have
violated these Provisions and caused pollution damage to remedy the
situation within a prescribed period of time, pay the expenses for
eliminating the pollution and compensate for the losses thus incurred and
may also give them a warning or impose a fine on them.
Any party concerned that does not accept the penalties may file a suit
with a people's court within 15 days of receipt of the written decision
concerning the penalties. If no suit is filed and yet the decision is not
carried out within the prescribed period of time, the departments for
environmental protection or other competent departments may apply to the
people's court for the compulsory enforcement of the decision.
Article 12
The people's governments of the provinces, autonomous regions and
municipalities where the economic zones open to the outside world are
located may formulate measures for the implementation of these Provisions
in accordance therewith.
Article 13
These Provisions shall go into effect on the date of promulgation.

各产煤省、自治区、直辖市及新疆生产建设兵团安全生产委员会:
  2011年4月15日14时30分,云南省曲靖市宣威市海岱镇杨梅山煤矿发生一起重大瓦斯爆炸事故,造成12人死亡,3人受伤。事故发生后,该矿转移4名遇难矿工遗体,并伪造入井检身记录,谎报事故真相。
  该矿为乡镇煤矿,资源整合主体矿井,整合临近的海东煤矿(已实施关闭),整合后设计生产能力为9万吨/年。该矿为高瓦斯矿井,事故发生时未经复工验收,所安装的瓦斯抽放系统未运行、监测监控系统运行不正常。初步分析,事故的直接原因是:矿井停电停风后,井下部分巷道瓦斯积聚并达到爆炸浓度界限,恢复供电后K7运输巷煤电钻综合保护装置失爆产生火花,引起瓦斯爆炸。
  事故发生后,该矿矿主及有关人员无视国家法律、无视矿工生命,隐瞒事故真相,伪造入井记录,性质严重,社会影响极其恶劣。为深刻吸取事故教训,切实加强煤矿安全生产工作,有效防范和坚决遏制煤矿重特大事故,促进煤矿安全生产形势持续稳定好转,特提出以下要求:
  一、突出抓好煤矿复产复工验收工作。要进一步明确煤矿复产复工验收责任制,对放假与停产检修煤矿,要逐矿落实复产复工验收责任,确保严格有序恢复生产建设。要严把复产复工验收关,坚持“谁验收、谁签字、谁负责”,严格按照程序和要求认真进行煤矿复产复工验收,切实保障工作质量,严防走过场。要加大对尚未复产复工验收矿井的监督检查,依法严厉打击未通过复产复工验收、违法组织生产建设行为。煤矿复产复工前必须制定送电、恢复通风和排放瓦斯的安全措施,矿井复产复工验收前瓦斯排放必须由专业救护队伍实施,严禁盲目下井查看情况或作业。
  二、切实加强煤矿“一通三防”和机电设备管理。矿井和采掘工作面必须建立稳定可靠的通风系统,定期检查和维护风门、风筒、密闭等通风设施并保持完好无损,严禁无风、微风作业。要认真组织落实“先抽后采、综合治理”的瓦斯防治根本措施,并加大瓦斯抽采力度,高瓦斯和突出矿井要严格落实瓦斯应抽尽抽、不抽不采的要求,抽采不达标的矿井要依法责令停产整顿。要加强作业现场瓦斯实时监测监控和瓦斯检查,监测监控系统传感器等设备要齐全,并按期调校,确保运行可靠,能反映监控场所瓦斯的真实状态。要加强电气设备的检查和维护,杜绝设备失爆,并及时淘汰落后老化、不符合防爆要求的机电设备。
  三、依法严厉打击瞒报和谎报事故行为。要依照《生产安全事故报告和调查处理条例》等规定,对瞒报、谎报事故的当事人和参与者要依法从严从重查处,构成犯罪的要移交司法机关依法追究刑事责任。要进一步健全举报制度,充分发挥社会公众的监督作用,鼓励和支持群众监督、媒体监督,认真及时处理人民群众和新闻媒体的举报信息。
  四、加大用事故教训推动工作力度。国务院安委会已对这起重大事故的查处实施挂牌督办,要求有关地方政府、有关部门按照《国务院关于进一步加强企业安全生产工作的通知》(国发〔2010〕23号)要求,坚持“四不放过”和“依法依规、实事求是、注重实效”的原则,严格事故查处和责任追究。认真吸取事故教训,切实落实整改措施。各地区要深入分析辖区内事故发生的原因、特点,总结教训、查找漏洞,对查出的问题和隐患要采取针对性措施及时予以整改,切实加强和改进煤矿安全生产工作。
  请迅速将本通报精神传达至辖区内有关地方政府和所有煤矿企业,并督促抓好贯彻落实。
